Abstract
According to the methodology of Imam Malik and his followers, differences of opinion among Muslims in matters of principle or jurisprudence do not contradict the essence of Islam and do not nullify the pillars of monotheism and prophethood. For this reason, Maliki scholars, despite the emergence of theological and juristic disagreements, have refrained from declaring their opponents as unbelievers or expelling them from Islam. The Maliki school is based on recognizing the Islam of opponents and forbidding the excommunication of Muslims. However, some Maliki scholars have issued fatwas of disbelief against opponents based on particular issues—judgments that deviate from the fundamental Maliki methodology. This article outlines the Maliki approach to Takfir, presents examples of such irregular fatwas, and critically analyzes them as departures from the school’s established principles.
